Many business owners assume that if an employee goes "Absent Without Leave" (AWOL) for a week, they have resigned. This is a dangerous legal misconception. AWOL is merely a disciplinary infraction; Job Abandonment is a deliberate legal ground for termination that must be explicitly proven.

The Two-Prong Test for Abandonment:

To successfully defend a termination based on job abandonment, the employer must establish:

  1. The employee failed to report for work without a valid, justifiable reason.
  2. The employee clearly intended to sever the employer-employee relationship (deliberate intent).

The Mandated Administrative Process:

Do not clear out their desk or stop their payroll processing immediately. You must send a Notice to Return to Work to their last known home address via registered mail. If they fail to reply or report back within the deadline specified in your notice, you must then issue a standard Notice to Explain for their unexcused absences before finalizing the termination.
